All You Need to Know About Workers’ Compensation

DenbeighBy DenbeighMay 9, 2024

Workers’ compensation is a broad field encompassing state-mandated financial and medical assistance for employees injured while on the job. The primary motive is to promote a safe working environment and ensure all employees are healthy.

How Does Workers’ Compensation Insurance Work?

First, workers’ compensation insurance is a state-regulated insurance system that caters to employees’ medical bills and damages when they get injured on the job.

In the US, individual states set up the rules and regulations surrounding this field. That said, Texas is the only state where employers do not have to set up worker’s compensation cover.

It is worth noting that the rules and regulations vary significantly from state to state. For example, in some jurisdictions, the size of the workforce determines whether an employer must offer workers’ compensation.

The Workers’ Compensation Board is responsible for the entire program and intervenes in some situations to determine the reimbursements to be paid by the employer.

What Is the ‘No-Fault’ System in Worker’s Compensation?

The ‘no fault’ system in workers’ compensation refers to insurance where the injured employee does not have to prove the employer was directly responsible.

This system’s primary goal is to ensure employees get compensation without lengthy court battles to determine the at-fault party. It provides a seamless compensation process for employees.

However, the specific rules surrounding workers’ compensation vary from state to state. Hence, it is imperative to consult an attorney familiar with your state’s laws.

What Is Workers’ Compensation Injury Care?

Workers’ compensation injury care is the treatment accorded to employees who get injured or become ill due to the nature of their jobs. Occupational medicine physicians are typically responsible for treating these patients.

These physicians have experience in worker’s compensation law and comprehend the need to return injured employees to work. On top of that, they can help determine the compensation you get after assessing the extent of your injury or illness.

With this in mind, workers’ compensation injury care is designed to ensure workers return to work as soon as possible, having received sufficient medical treatment.

In some situations, workers may require ongoing treatment and rehabilitation. Occupational medicine physicians work closely with employers and insurers to ensure the patient receives quality care.

Common Workplace Insurance Claims

Below are some of the most common workers’ compensation claims

  • Overexertion- injuries due to overeating yourself, such as when lifting heavy objects
  • Falls, slips, and trip injuries
  • Transportation injuries
  • Violence in the workplace
  • Exposure to harmful environments
  • Contact with objects or equipment

What Kind of Injuries Are Not Covered Under Worker’s Compensation?

In some cases, injured workers can be denied compensation. Here are a few of those cases:

  • Injuries due to drug intoxication
  • Injuries to an independent contractor
  • Injuries after the employment contract is terminated
  • Felony-related injuries
  • Wounds from a fight started by an employee
  • Injuries from a violation of company policy, self-inflicted injuries

Workers Compensation Benefits

It is crucial to note that workers’ compensation benefits vary according to the jurisdiction, and in some areas, only specific employees are covered. For instance, in some states, small businesses are excluded from the mandate.

That aside, typical compensation includes salary replacement, healthcare cost reimbursement, and survivor benefits. On top of that, claimants can also receive temporary disability payments, which, in most states, equals two-thirds of their average salary.

If a worker is permanently disabled and unable to perform their duties, they may qualify for a lumpsum reimbursement benefit throughout their disability.

The Employers’ Role in Workers’ Compensation

The employer also has a role to play in workers’ compensation. For one, they must inform their employees whether they are self-insured and display the carrier’s contact information.

On top of that, the employer must give sufficient information regarding the available benefits. In brief, the employer must inform employees they have the right to compensation.

Filing a Workers’ Compensation Claim

If you have been injured at work, you must familiarize yourself with your state’s laws before filing the claim. Better still, you should contact an attorney who will help you go over the rules and help you with filing the claim.

As the injured employee, you should start by seeking medical attention and inform your employer, who will then provide a workers’ compensation claim within 24 hours of getting notice.

Key Takeaways

Workers’ compensation law varies according to the jurisdiction. Each state has a workers’ compensation board that oversees such cases and intervenes when necessary.

“If you are injured at work, you should seek medical attention and inform your employer, who will provide a workers’ compensation form. When filing the claim, you should seek assistance from a qualified lawyer to help streamline the process.” says attorney Sheryl Lam of Silberman & Lam, LLP.
